These Terms of Service (the “Terms”) are a binding agreement between you and Spacedust LLC, a Washington limited liability company (“Spacedust,” “we,” “us,” or “our”) and govern your access to and use of spacedustai.com and any games, apps, and services we provide that link to these Terms (together, the “Services”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
2. Accounts
Some Services may require an account. You agree to provide accurate information, keep your credentials secure, and notify us promptly of any unauthorized use. You are responsible for all activity that occurs under your account.
3. License to use the Services
Subject to your compliance with these Terms, Spacedust grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your own non-commercial entertainment purposes. All rights not expressly granted are reserved by Spacedust and its licensors.
4. Acceptable use
You agree not to:
- Use the Services in violation of any law or regulation;
- Cheat, exploit bugs, or use bots, hacks, or unauthorized third-party software;
- Copy, modify, reverse engineer, decompile, or create derivative works of the Services except as permitted by law;
- Harass, threaten, or harm other players, or post content that is hateful, sexually exploitative, or otherwise objectionable;
- Attempt to manipulate AI features to generate unlawful, harmful, or infringing content, or to circumvent safety systems;
- Interfere with or disrupt the integrity, security, or performance of the Services;
- Scrape, data-mine, or harvest data from the Services without our written permission.
5. Your content
You retain ownership of any content you submit to the Services, such as text, prompts, creations, and feedback (“Your Content”). You grant Spacedust a worldwide, non-exclusive, royalty-free, sublicensable license to host, use, reproduce, modify, display, and distribute Your Content as needed to operate, improve, and promote the Services. You represent that you have the rights necessary to grant this license and that Your Content does not violate these Terms or anyone else's rights. If you send us feedback or ideas, we may use them without obligation to you.
6. AI-assisted development & content
Spacedust uses artificial intelligence tools throughout our development process, including to help generate code, artwork, audio, text, and other game content. All such content is reviewed and directed by our team, but because it is produced with generative tools, it may occasionally contain errors or resemble other material. If you believe any content in our Services infringes your rights, please contact us as described in Section 8.
Some Services may also include features that generate content in real time. Such output is produced automatically, may be unpredictable or inaccurate, is fictional, and does not constitute professional advice or represent the views of Spacedust. We use safeguards to reduce inappropriate output but cannot guarantee that all output will be appropriate; please report problematic content to us.
7. Virtual items & purchases
Our games may offer virtual currency or items. These are licensed to you, not sold, have no real-world monetary value, and cannot be exchanged for cash. Except as required by law or by the rules of the platform through which you made the purchase, all purchases are final and non-refundable. Purchases made through third-party platforms (such as app stores) are also subject to those platforms' terms.
8. Intellectual property
The Services, including all software, artwork, audio, text, characters, trademarks, logos (including the Spacedust name and logo), and other content, are owned by Spacedust or its licensors and are protected by copyright, trademark, and other laws. You may not use our trademarks without our prior written permission.
If you believe content on the Services infringes your copyright, please send a notice to support@spacedustai.com with the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512).
9. Third-party services
The Services may contain links to or integrations with third-party websites, platforms, and services that we do not control. We are not responsible for their content, policies, or practices, and your use of them is at your own risk.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY CONTENT, INCLUDING AI-GENERATED CONTENT, WILL BE ACCURATE OR RELIABLE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPACEDUST AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Spacedust and its members, managers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, Your Content, or your violation of these Terms.
13. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or to protect the Services or other players. You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnification.
14. Governing law
These Terms are governed by the laws of the State of Washington and applicable U.S. federal law, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in the State of Washington, and you consent to their personal jurisdiction, except where prohibited by applicable consumer protection law.
15. Changes to these Terms
We may modify these Terms from time to time. When we do, we will update the effective date above and, for material changes, provide reasonable notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
